Please read these terms and conditions carefully. These Terms constitute a binding agreement between you and Linus Guiding Services, dba Mountain Adventures (“Mountain Adventures,” “we,”, “us” or “I”). By booking a trip or service with Mountain Adventures, you agree, on behalf of yourself and all other individuals you book for, to be bound by these Terms. You further acknowledge that you are acting as an agent for such other individuals, and these Terms apply to them as well.
TERMS
Guide Operations
Mountain Adventures reserves the right, in its sole discretion, to operate its guiding programs in the manner it deems appropriate. This includes, but is not limited to, modifying or canceling any program or service without notice or reason. Mountain Adventures guides reserve the right to cancel any day at any time if they deem the risk of injury or harm too significant to manage. Mountain Adventures is not responsible for any expenses guests may incur due to cancellations. Guides are subject to change at Mountain Adventures’ discretion.
For Lyngen trips specifically, itineraries may be modified due to weather, snowpack, ferry schedules, or other local travel disruptions. Lodging and catering arrangements are confirmed in advance and are non-refundable once booked.
No Guarantee
Mountain Adventures does not guarantee any specific outcomes or satisfaction from trips or services. Purchasing a trip or service from Mountain Adventures does not guarantee:
- Any particular guest experience or level of satisfaction at a trip location, with any service, or during a guided trip.
- Your participation in any trip or package, which may be subject to capacity limits, guest-to-guide ratios, and minimum participation requirements.
- Any guarantee of specific objectives or number of ski days. Lost ski days due to weather, storms, or transportation disruptions do not entitle guests to refunds.
Release of Liability, Assumption of Risks, and Indemnity Agreement
All participants of any Mountain Adventures trips or services must review and agree to the Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement (the “Waiver”) as a condition of participating in the trip or service. If a Waiver is not completed, the individual will not be permitted to participate in the trip or service. Participants who did not make the booking, or who are added or substituted after the original booking are subject to this Waiver Requirement – if such individuals do not complete the Waiver they will not be permitted to participate. You will not be eligible for a refund based on any failure or refusal to sign the Waiver.
PLEASE READ THE WAIVER CAREFULLY! By signing you will waive or give up certain legal rights, including the right to sue for negligence, breach of contract, or breach of any Occupiers Liability Act or claim compensation following an accident. If you are booking for other guests, it is your responsibility to bring this requirement to their attention and to forward any correspondence to them. The Waiver can be found by clicking HERE.
Participation Agreement
At the time of your purchase, you will be required to carefully read, agree, and sign the Participation Agreement. If you do not agree to the Participation Agreement then you will not be allowed to participate in any trip or service. Furthermore, any participant, including those who did not make the initial booking, those who take the place of a guest who cancels, or those who show up last minute without making Mountain Adventures aware, will need to fill out a Participation Agreement.
Trip-Specific Terms and Conditions
Lyngen trips, including lodge-based, catered, or custom programs, have unique payment schedules, cancellation deadlines, refund conditions, and participation requirements that differ from our standard policy. These trip-specific terms override the general terms listed here. By confirming your booking, you acknowledge and agree to these trip-specific terms as communicated to you in writing.
Key terms for Lyngen trips:
- A non-refundable deposit is required at the time of booking to secure an individual spot.
- For group bookings, full payment is required at the time of booking.
- The remaining balance for individual bookings is due 90 days (3 months) prior to the trip start date.
- All payments are non-refundable, except in the event of a confirmed replacement participant (see Cancellation Policy).
- Participants are responsible for arranging their own travel to Tromsø. Missed flights, ferry cancellations, or other travel disruptions are not grounds for refunds.
Cancellation Policy
Mountain Adventures strictly enforces its cancellation policy. All payments are conditionally non-refundable. We highly recommend purchasing trip cancellation insurance to protect your investment. Please read the following carefully:
- Trips must be secured by deposit or full payment. Full payment is due 90 days before the trip start date unless otherwise specified. Bookings made less than 90 days before the start date require full payment to secure.
- All cancellations must be received in writing by email.
- If notice is received less than 90 days before the start date, no refunds will be issued.
- If you cancel more than 90 days before the start date, your deposit is forfeited, but the following may apply:
- You may find a suitable replacement participant. If accepted, your payment will be refunded minus an administrative fee and any third-party costs.
- For group bookings: if one member cancels, no partial refunds will be issued. The group is responsible for handling any replacements.
No refunds are provided for cancellations due to injury, illness, or personal reasons, nor for guests who do not show up, show up late, leave early, or lack adequate ability or fitness.
Minimum and Maximum Attendance
Mountain Adventures may cancel trips that do not meet minimum attendance requirements. If a Lyngen trip is cancelled due to low enrolment, you will receive a full refund of payments made. Mountain Adventures is not responsible for any additional expenses incurred, such as flights, hotels, or other travel costs.
Force Majeure
If a trip is cancelled due to circumstances beyond our control (“Force Majeure”), no refunds will be issued. Force Majeure events include, but are not limited to, ferry cancellations, flight delays, lack of snow, government lockdowns, natural disasters, pandemics, war, highway or road closures, and any other unforeseeable and uncontrollable events. Trip cancellation insurance is highly recommended for these scenarios.
Avalanche Safety Training Requirement
All guests must complete a basic Avalanche Safety Briefing on the first morning of a trip. Guests who are unable to attend the briefing must arrange a one-on-one session with their guide. Failure to attend this briefing will result in denial of participation, with no refund provided.
Equipment Requirements
All guests must have the appropriate equipment. Lack of proper equipment does not warrant last-minute cancellations or refunds. There will be no refund due to guests showing up with inappropriate, defective, or lack of required equipment. It is the guest’s responsibility to have all required equipment, including items suitable for Arctic conditions. Equipment lists are available upon request or will be provided with trip information for each specific trip.
